James T. Webb is asking the United States Attorney for the Eastern District of North Carolina; Robert J. Higdon, to stand up against powerful corruption and to dismiss his 3rd federal prosecution in the same federal case in controversy, that some call a federal case without comity that is ultra vires and triple jeopardy against Wilmington N.C. native and African American Builder James Thomas Webb. Quo Warranto. Webb, who undisputedly created 1000's of construction jobs for construction craftsmen and rebuilt 100's of homes within eastern North Carolina's poorest communities says he has presented conclusive evidence of an over 40 member, powerful banking risk management group of individuals who fraudulently concealed circulated emails and held target training sessions at FDIC banks; specifically for the purpose of plotting on how to close Webb down; before over 100 families renting Webb's rebuilt homes in eastern N.C. were run out of their homes to make way for false claims submitted to federal officials after the same homes were either stripped, torn down or burned down by privies of the group. Webb says this all occurred after members of this same group admitted that Webb's construction and real estate model was very successful and that Webb had not committed any crimes. Webb has presented evidence that a potential key witness to their crimes, a Mr. William K. Graham, was killed to further conceal their crimes.After 10 years of vexatious litigation and a highly financed negative public relations campaign against his businesses, Webb says the EDNC US Attorney's office made it very easy for him to falsely admit guilt, in a case which invoked the same fear in Webb as in defendant I.H. Hammerman II in 1975 (528 F.2d. 362 CA4). Webb says he was too afraid "not" to plead to the system in this 3rd federal re-litigation against him. Even though he knew he was and is innocent.While persisting of his innocence, Webb says even his court appointed attorney; Todd Allen Smith told Webb to "find something you can say you are guilty of so they can have something to hang their hat on...they are gonna work with you". This case was the American Criminal Justice System at it's worst Webb says. This federal case dates back to 2002-2005 and was prosecuted 3 times as a federal case; 07-61655 in the Southern Dist. of Fla (Case Closed 2009); case 12-3263 S. Dist. Fla and again in 2012 as case 5:12-cr-301 EDNC. However, Webb says there is even more to this story. Acting Chief of the Department of Justice Civil Rights Unit, Criminal Investigative Division of the F.B.I. John Shimp referred to as the "Civil Rights Banking Conspiracy" as he referred Webb's case over to the F.B.I. Charlotte Field office for appropriate action. Webb says that those banking employees behind the case are so powerful that he has been in prison on their unconstitutionally "grafted" case, in violation of his Due Process 5th Amendment rights for over 7 years now. Webb says "enough is enough, it is time to get back to rebuilding America's poor communities (Empowerment Zones) just as the U.S. Securities and Exchange Commission signed a contract allowing me to do, before Federal Judge Donald Middlebrooks CLOSED this case back in 2009 in the Palm Beach Florida Federal District court." Webb asks Higdon to dismiss this case, as citizens from across North Carolina and across this nation want and need this case over with immediately, so that Webb can get back to rebuilding homes in, for and by low income residents across America.Webb says the hardest thing for him in all of this, is to say he is sorry for something he did not do. However, Webb does say "thank you" to Mr. Higdon's office for giving him the opportunity to have taught over 300 inmates on how to become Construction Managers as he served as Lead Instructor in Real Estate and Construction at FMC Butner. Subject:  BANKING ANTITRUST CIVIL RIGHTS CASE TO RETURN TO BANKRUPTCY JUDGE JOHN K OLSON FOR REOPENING RECONSIDERATION


African American builder James Thomas Webb will ask Judge John K. Olson to reconsider his motion to reopen his Chapter 13 case under 11 U.S.C. 350 and 5010 along with the All Writs Act for the investigation of the Civil Rights Anti Trust Conspiracy and the illegal incarceration of this Affordable Home Builder who rebuilt homes in what America now refers to as "Enterprise Zones". This will give Judge John K. Olson jurisdiction to issue for Webb a habeas corpus to release Webb from an illegal prison sentence in a case which was re-litigated 9 times after the "combination" was unsuccessful from 2003 until 2012 in "closing Webb down". On November 4th, 2019 Webb's motion was denied at a hearing in Fort Lauderdale by Judge John K. Olson. As Webb spoke, he was careful to "not" disrespect the Judges' wishes and kept his responses to only a few sentences which the court asked him to do. Unfortunately, Webb did not have the time to inform the Judge about the suspected murder of a key witness in his case, named William K. Graham from Durham County, NC. While on the subject, there is no statute of limitations for murder. Webb previously stated and continues to stand on the fact, that this particular witness had additional evidence of how members of the antitrust combination forced over 100 residents out of his rebuilt homes in downtrodden communities (Empowerment Zones) across 7 states before they stripped the homes and burned some of them to the ground and submitted False Claims to a federal official for payments from the government on losses which they created. There was never a discussion about the due process violations against Webb and his estate in this 16 year long vexatious case in controversy. Webb's estate was unsuccessfully sued 8 times before they lied to NC prosecutors and now Webb has been illegally in prison for over 7 years as a result of their false and highly financed media campaign despite his desire to reopen his Chapter 13 case to convert it to a Chapter 11 case to make his creditors and investors whole and to be personally returned to his status quo ante of September 4, 2012. Webb and his investors lost millions from these antitrust violations and Webb hopes that this time the Judge will have the time to fully consider all his arguments and that the "combination" members will not attempt to influence the Judge's decision and that "this time" the Trustee for Webb's estate will read Webb's motion and briefs to get an understanding where the jurisdiction lies for his creditors and for the debtor. In a case with it's roots in economic liberty, on Monday November 4, 2019 at 1:00PM at the United States Bankruptcy Court, 299 East Broward Blvd. Courtroom 301 Fort Lauderdale, FL. James T. Webb, known by his supporters as the nations' largest redeveloper of previously distressed single family homes in America's most downtrodden communities (currently called Empowerment Zones) will take the stand to plead his case and seek impunity. Webb would like you to take notice since he created 1000's of construction jobs for low income craftsmen and provided close to 1000 quality affordable homes; he rebuilt a city block of homes in one city where his Companies alone rebuilt and rented out 180 affordable single family homes.

However, there was no medal of honor received for his good works, only retribution. Around 2003, a group of over 40 Risk Management Banking employees and others in high positions from the Eastern District of North Carolina privy to the injustice "combined" as they circulated the following email:

"I will hold off on closing down Webb, I will be riding out to his Boyce Mill Address this afternoon, however all the reports I get back is that he makes his investors huge profits and gets good rents for the houses that they rehab. His model appears to be successful. I will keep you posted. Our best chances on this one is to work together." They did just that and in the process broke many antitrust laws.. But why? And how many "good people" did they get involved from Florida to N.C. to help them break federal laws to accomplish their goal to close Webb down?

Webb, at his peak did produce 1700 percent cash on cash annualized returns which made his competitors angry. However, he was not a banking risk management threat at all. Webb was and still is only a threat to poverty, blight, violence, joblessness and homelessness in America's downtrodden communities. Nevertheless, 16 years later at the hands of a couple of government officials who assisted the "combination" Webb fights for economic liberty, his estate, his creditors, his physical liberty and the future of the residents who currently live in America's Empowerment Zones. Webb is asking for the Fort Lauderdale Community and for the nation to come together to support his efforts to Reopen his bankruptcy case; for his estate and his creditors and to investigate powerful antitrust actions during his case, which Webb discovered after his case was closed, including over 100 families in Empowerment Zones being forced to move from their homes; the stripping and burning of many of these homes. One suspected extra judicial killing of a key witness and more. Webb is asking for the nations support as he also ask the Honorable Judge John K. How can both, the Milken Institute and The Webb Institute provide Affordable Housing across America? Through Opportunity Zones! During the 2000's, with over 100 previously vacant and condemned homes undergoing renovation construction under his belt; Master Builder James T. Webb created The Webb Institute Of Construction Technology, LLC. These homes were located in the heart of America's most downtrodden neighborhoods across 7 states. The same Bankers who previously loaned millions of dollars to Webb for building upscale mansions denied his request and told him NO for loans in downtrodden communities. Webb went on and raised over 8 million dollars starting in 2002 and produced revenue over 100 million dollars by 2007 according to the Securities and Exchange Commission. Webb's model for affordable housing, at it's peak produced returns up to 1700 percent annually and was about to open many doors including the expansion of The Webb Institute of Construction Technology, LLC in an abandoned Theatre in Raleigh, N.C. This venture was to be an enhancement tool in the "Earn While You Learn Program" while also being attributed as an empowerment program.

Today, with empowerment zones in place and the potential help of Wall Street Legend Michael Milken and with the assistance of President Trump; Webb's dream may come true. With one specific and primary condition "NO TAKEOVER". Webb says he was sent to prison at the hands of an antitrust banking conspiracy that attempted to take over his Companies. After 8 failed times (once in an SEC case where Webb emerged with a 2009 settlement agreement in the Southern District of Florida).

Webb say's Milken will need his help to redevelop America's over 8000 empowerment zones just as Webb needs President Trump's help as he seeks a Presidential Pardon like Milken. Webb's case is "straight DOUBLE JEOPARDY" from an (illegally GRAFTED prosecution https://payhip.com/b/940q) (Book - THE PURGE) as 3 years after the SEC settlement, a different federal district in a different state filed an indictment on the "same CLOSED SEC case".

Webb, however, was not as fortunate as Milken. Webb received a 27 year sentence for 1 count of wire fraud even after surviving the SEC complaint with allegations of 10-5 Securities violations in the SEC case. Webb said with Blockberger Element's test and Neder v. U.S. 144 Led. 2d. 35, 527 U.S. 1 that should never have been possible in America. Undisputed even that chief agent, A. David Williams of the SEC confirmed that the allegations against Webb were "Plain Lies". Webb's fines were 0 (zero). In Milken's case the fines were 600 million dollars. On Nov. 4th Webb has a hearing in Fort Lauderdale bankruptcy court to Reopen his 2006 bankruptcy case under Title 11 U.S.C. 350 and Rule 5010 to aid Webb in investigating the Civil Rights Banking Conspiracy which collapsed his Companies. Webb is planning to file his antitrust complaint seeking a minimum of 1.7 Billion dollars from the Risk Management Bankers who began in 2003 to take his liberty. Political Lynching of Black American Master Builder 


Like President Trump; Black American Master builder James T. Webb says that "he too" was lynched; in 1990 and again in 2012. To understand the word 'lynching' one must first understand the legal term "lynch law" n. the act or practice by a self-constituted court of condemning a person and ....usually inflicting death upon him for a presumed crime or offense without due process of law. (Pg 1351 Webster's 3rd. Intl. Dic. unabridged) Year 1989 in Wilmington, N.C., home of the 1898 race riot and home of the Wilmington 10, native Wilmingtonian Webb had risen from a kid in the Hillcrest projects on Dawson St. to become Wilmington N.C.'s largest Black owner of Real Estate. Webb purchased and rebuilt close to 100 affordable single family homes. Putting 100's of local construction laborers to work. In 1990, Webb was asked to switch parties to be appointed to run in former Mayor Barry Williams seat for the N.C. State House in the upcoming general election. Webb received a unanimous vote from the Republican Executive Committee.If elected Webb would have been the 1st Black Republican in the State House from Wilmington, N.C. since Reconstruction. After receiving the nomination from the party, the opposition pulled a Judge out of retirement for the sole purpose of REMOVING Webb from the Ballot, "without due process". This is when the 1st witch hunt began. Webb was forced into bankruptcy (chapter 7) and was soon facing a federal Judge in a criminal case.   According to the Wilmington Star News, former N.C. GOP Lawyer and lawyer for Webb; Archie Allen called what was being done a "black robe lynching". However, the federal Judge FOX in Wilmington told Webb, "whatever you do, don't you ever give up on rebuilding homes in your community. Your community needs you". Webb listened to him.  By 2006 Webb had rebuilt close to 1000 affordable homes that were previously condemned and slated for demolition. He rebuilt the homes by putting to work thousands of construction workers across 7 states where the homes were located. President Obama told Webb in Florida, in 2006, before he announced his run for Presidency, that he knew Webb was catching hell rebuilding those communities but promised that things were going to change because "we are going to take the White House", Obama said and won!. In 2006 Webb was forced into a second bankruptcy. In 2007 he was sued by the Washington, D.C. Securities and Exchange Commission.They transferred the case to Palm Beach Florida Federal Court and in 2009 signed a settlement agreement with Webb which allowed Webb to continue rebuilding America's Low Income Black Communities. Federal Judge Middlebrooks CLOSED that case Sua Sponte, on August 10, 2009. In September 2012 (without due process) Webb was this time criminally indicted in the SAME 2007 case; 3 years after the case had already been CLOSED. This time in a whole new federal district, The Eastern District of North Carolina. (Webb's home). This all happened, Webb says, as black leaders who knew the great work he had done rebuilding the community, remained as quiet as mice while thousands of construction workers loss jobs. Ultimately, over 100 low income black families were forced to leave their rebuilt homes; some of these homes were even burned to the ground. The opposition, making their way for the second "2012" lynching where at Webb's sentencing they said they put the nail in his coffin. Webb received a defacto LIFE sentence for rebuilding poor black communities under America's 1st Black President. Webb says to Representative Clyburn regarding his comments about President Trumps' use of the word 'lynching' ..."enough already, it's time for Black leaders to show courage on both sides and to stand up for what is fair and just for all people regardless of political affiliations, financial influence, fear, gender, race and demographic background. Just, no matter who you are. And if you are Black, then for heavens sake 'SAY IT LOUD, I'm BLACK and I AM PROUD".

potential frightened them as a RISK FACTOR as some depositors were withdrawing millions of dollars and investing into Webb Companies; financing his redevelopment of America's Hoods when the Banks refused to. Webb's enemies pulled out all the stops; forced over 100 poor families out of the rebuilt homes; had the homes stripped, torn down and even had some homes burned to the ground and even caused some job site disturbances, for example;
a stabbing of a worker in the neck in Miami; established a stash house to store the stripped materials from the homes and when Webb (while in jail) requested a subpoena deuces tecum on the key witness who engineered the destruction of the homes for testimony under immunity, the witness mysteriously ended up dead. Reopening of a Florida bankruptcy case may pave the way for a multi-billion dollar race based antitrust lawsuit African American Builder James T. Webb moved his family to Miami Florida as a safe haven away from the Eastern District of North Carolina where he grew up and also, where as a child, race was never a problem for him. Growing up in North Carolina, Webb became Student Government President at North Brunswick High School in Leland N.C.; Most Valuable Player on the Basketball team; Brunswick County winner of the Odell and Virginia Williamson Oratorical Scholarship award which helped pay his way through college at North Carolina Central University where he was chosen as Who's Who Among University College students and served as President of the Student Body.
In hindsight, what Webb experienced in regards to race relations as a child growing up, was much different once he became a businessman, as he was rebuilding distressed homes in North Carolina's and other states poorest African American Communities. As a commercial unlimited builder Webb also built mansions, and different Church construction projects such as his renovation of the new Chancel renovation at the world renown White Rock Missionary Baptist Church in Durham, N.C. Although he was successful with these latter ventures, his passion was to focus on rebuilding homes in America's "hoods". While living out his passion project, Webb was able to watch and see as the homes and the lives of the local construction workers became rejuvenated. Webb not only rebuilt 100's of previously condemned single family homes; he also rebuilt the lives of 100's of men. Many of who were ex felons. Together they rebuilt these homes which many in the community previously called "crack homes or trap homes" that were beyond repair. Webb had a vision for these homes and for these communities. The homes were beautiful before the antitrust combination destroyed them.
Since Banks would no longer loan Webb money to rebuild in these poor communities Webb went to private investors for loans and created a portfolio of around 500 homes in N.C., Va. Tenn., Ark., MO. and Ill as he transitioned his business from Raleigh N.C. to Weston Florida. Noteworthy is prior to not qualifying for loans to rebuild poor communities, one bank had offered Webb a million dollar loan to build a 1.8 million dollar SPEC home. After winning 8 battles in multiple venues which were sponsored by the antitrust conspirators as they worked to "close Webb down", Webb was allowed by government agencies to advance his model with certain compliance and securities filing requirements. WAHM (Webb Affordable Housing Model) created 1000's of short term construction jobs and curved recidivism in the markets Webb worked. In the 9th vexatious action against Webb which unconstitutionally took his freedom with the same case that was CLOSED by Federal Judge Middlebrooks in Palm Beach in 2009, mysteriously was transferred (3 years later) back to N.C., the home of a group of over 40 members of the antitrust combination in their last effort to "close Webb down" and to take his liberty, as they promised in emails that they would do while admitting Webb had broken no laws. Their antitrust actions were discovered by Webb after they forced him into bankruptcy and after his bankruptcy case had closed. Because of a federal bankruptcy law Title 11 U.S.C. 350 and Rule 5010 Webb is now entitled to file for his bankruptcy case to be reopened in order to investigate the antitrust actions. This action can bring substantial value to Webb's creditors and to Webb's Estate.
Despite his challenges; Webb has continued to teach hundreds of men construction methods and how to become builders, while in prison. During this difficult journey to freedom; Webb has also reached out to mentor many of his students relatives to help them get into the construction business as well. As a result Webb's teaching thereby is providing legitimate careers in construction and not destruction for those returning home, some even earlier than expected as a result of The First Step Act" .
