West Palm Beach, FL On May 11th, former Chief Federal District Court Judge Donald Middlebrooks responded to an EMERGENCY

MOTION FOR RELIEF (Due to COVID-19 Medical Risk Factors) filed by elderly African American Builder James Thomas Webb. The motion was filed at the court house at 11a.m. and was answered a little after 1p.m. by Judge Middlebrooks on the very same day. Unfortunately for Webb the motion was filed in the "wrong case". According to Judge Middlebrooks's Order Webb's Motion needed to be filed, not in his closed SEC case, but in Webb's closed criminal case which was filed by the government 3 years after the settled United States Securities and Exchange Commission case against Webb was closed by Judge Middlebrooks. While a core proceeding, the criminal case was not filed against Webb by the Southern District of Florida U.S. Attorney's Office. According to Webb the Miami F.B.I. agents who processed Webb for North Carolina almost 8 years ago told him in the North Miami Beach F.B.I. field office that "they" had nothing to do with the North Carolina criminal case against Webb; which was according to legal scholars filed over 3 years too late and in the "wrong federal court"; in the Eastern District of North Carolina, instead of in the Southern District of Florida, which had original jurisdiction and retained jurisdiction over Webb and over the subject matter of the case.

The alleged unlawful single sovereign double jeopardy criminal case is now the subject of a GREAT WRIT in the Southern District of Florida as a part of case 1:20-cv-21522, filed by Webb. The case is to be heard by the current S.D. Fla. Chief Federal District Court Judge K. Michael Moore with Lisette M. Reid as U.S. Magistrate Judge. While Webb has a MINIMUM score under the First Step Act and qualified under The CARES ACT pursuant to Attorney General Barr's March 26, 2020 directive (and according to FBOP Unit Team Home Confinement request for Webb on April 16, 2020), Webb has yet to receive home confinement despite his medical risks which are heart, kidney and respiratory disease as well as diabetes. For Webb, home confinement, while a safer option than prison, is only one solution to his COVID-19 risk factors. Webb is now asking Chief Judge K. Michael Moore and or Magistrate Judge Lisette M. Reid to GRANT his GREAT WRIT and to DISMISS the charges in his N.C. criminal case which has due process violations requiring it's dismissal, and to ORDER his Immediate Release from federal prison in N.C.. Webb says the criminal case was filed 3 years after he and the government signed a settlement deal. However the government did not honor it's deal with Webb nor Chief Enforcement Agent A. David Williams' promise of immunity against criminal prosecution to Webb, and instead requested in the subsequent criminal case on behalf of the same parties, for the same timeframe, same common nucleus of operative facts and that Webb sign a "new deal" called a Guilty Plea to 1 count of wire fraud in what is really the "same case".

Instead of the zero restitution given to the government in Judge Middlebrooks case, the North Carolina federal agents through Judge shopping and using the same false narrative that Chief SEC Enforcement Agent Williams called a "plain lie", they received an 11 million dollar restitution order from a different Federal District Court Judge on behalf of the same parties who Webb alleges ran over 100 low income families out of his rebuilt homes before they had the homes vandalized, stripped and some torn and burned to the ground in a sophisticated mortgage dumping scheme. Webb has written 6 free books regarding the evidence in his case even as he has mentored and instructed as an ACE Tutor over 300 men on how to return home to rebuild their low income communities. Webb rebuilt close to 1000 homes and created 10's of thousands of construction jobs for residents of America's low income communities before his competitors convinced the government to advance their cause to "close Webb down". With the current financial crisis caused by COVID-19 in America's low income communities, there are sure to be many more victims like Webb, if the government is not woke.

The BOP has rules and regulations that makes it a little more difficult to just release federal inmates. The agency has even considered how some inmates who have nowhere to go will be handled. Or how those who live several hundred or thousands of miles away from home will get there; considering traveling accommodations are sparse; airline prices are skyrocketed and seats are limited, many buses have canceled routes and few hotels are opened. During this pandemic I know for those who can and will, they will travel the distance to pick up their loved one. As is the case for James T. Webb who is minimum risk and has been pleading his case of innocence since inception. He was never supposed to be here and like so many others is waiting for the BOP to release him immediately!

Washington D.C. Police officers, Black Doctors and Builders will soon be released from federal prison. The clock is ticking and with regulations and bureaucracy impacting the FBOP, despite calls by Attorney General William Barr and despite the diligent efforts of BOP officials, canceling visitation along with lock downs in what America would consider institutional quarantine for weeks; without executive action from President Trump it is likely that there will be unnecessary deaths from COVID-19 within America's federal prisons. The world watched as over 70,000 inmates were released from prisons in IRAN. But, for many inmates and the prison guards there, in the face of COVID-19 that action was just too late. On yesterday the U.S. Department of Justice confirmed there are 14 federal inmates and 13 BOP staff already infected with the corona virus. Based on the directives from Attorney General Barr many non violent prisoners with diabetes, heart and kidney diseases who will be released are also individuals who in fact gave their life in many instances, fighting for the most venerable in America but got trapped up into political and even corporate and private conspiracies designed to remove, a police officer in Louisiana who had protected citizens and their property; shut down black doctors who served inner city and rural poor citizens in Georgia and Virginia and helped to "close down" one of America's largest single family affordable home redevelopers and builders. While some like Dr. Clarence Scranage, Dr. John Glenn and former Police Officer Codi Dodge have not documented their story African American Builder (minimum score recipient on "risk assessment" algorithm called PATTERN) James T. Webb has documented his story in volumes of books written as evidence of the injustice he experienced. But like many others in the minimum category he has never had his grounds heard on the merits due to what is known as an Anders Brief and other highly technical rules and regulations which crippled small businessmen and has swollen the belly of what many call "The Mass Incarceration Voyager" years before President Trump even took office. I heard that there was a brother who had arrived at FMC Butner who was very brilliant and who had a nice real estate portfolio of around 20 rental homes and who had good knowledge in real estate and business. Having taught many classes in Real Estate and Construction along with other courses, some of my former students mentioned to me that I needed to meet Brandon. I invited him to sit in one of my classes and from that day forward we both became iron sharpening iron in our friendship. While I had met and taught some pretty sharp brothers Brandon was much different. I soon realized why. While construction was new to his volumes of knowledge, it did not take long for him to start to master principles of construction too. A teacher himself Brandon had a drive and thirst for knowledge unlike I had seen from other students. Literally hours upon hours, many times 9 hours straight, except for quick food and other small breaks Brandon was studying.

His thirst for knowledge was not just for his own benefit, but it was as if he was daily planning and visualizing an empire he was soon to build with his wonderful wife and children, all engaged in the process with him. Brandon taught everything he leaned in construction to his wife Tonica, who shook the nation of wives and other prison family members who on Wednesday nights taught each other principles of construction on phone conference calls based on the same weekly curriculum that the men were learning in my classes. Tonica was just like Brandon, all about action and making things happen. Brandon was proud of his mentorship as the pictures came back in and not only did the family's construction business grow but no local construction manager was needed as all of Brandon's master builder friends were inspired to actually see Tonica on top of the house roof giving directions to the workers. The Crawford Family has grown and is growing up the most brilliant and beautiful young women and kingly men who will change the world. While they say I have inspired them, both Brandon and Tonica have truly inspired me and I am sure as all of our irons continue to sharpen each other's irons the world will welcome our leadership, as we all bring about positive changes to the lives of many.

What most people, even those who do believe in God fail to realize is that fear is the opposite of love. Their polarities are tantamount to those of light and darkness. Press Release 3/12/20 - BUILDER JAMES THOMAS WEBB PRODUCES DOSSIER OF CIVIL RIGHTS BANKING CONSPIRACY

Raleigh N.C. A key witness who helped send African American Low Income Housing Builder and Redeveloper James Thomas Webb to federal prison for 27 years did not tell the whole truth in the federal court of Judge James C. Dever III before he left the [F.B.I.]. Before being sentenced, Webb had also for over 27 years rebuilt close to 1000 vacant or condemned affordable homes and created over 10,000 construction contract jobs for low income construction workers, mostly in Eastern North Carolina. Soon after Webb's sentencing hearing in the 2012-2014 re-litigation in the Eastern District of N.C. of the same 2007-2009 closed federal case originally filed by the federal government in the Southern District of Florida federal court, [F.B.I.] Agent Jim Cheroke left his position which he describes on line as Chief [F.B.I.] Agent for the Raleigh N.C. Office.

[F.B.I.] Agent Cheroke answered questions at sentencing from both Webb and assistant United States Attorney William Gilmore. Webb faced sentencing on 1 count of wire fraud in the 2012-2014 re-litigated case where that charge has the same elements as the prior 2007-2009 federal United States Securities and Exchange case charge under the 10b-5 of The Securities Act. The first case in Florida 2007-2009 and it's re-litigation in N.C. 3 years after the Florida federal case was closed, at the request of Cheroke during 2012-2014, was for the same offence timeframe of 2002-2006; for the same parties and privies; for the same real estate and investment contracts and transactions and based on the same common nucleus of operative facts. All issues in the first litigation that were raised or that could have been raised were adjudicated, including whether Webb had committed a crime with his investment company which the government said raised 8 million dollars from private investors and did over 100 million dollars in volume according to court records. Why and how was there a second federal case in a different federal court 3 years after the federal government signed a settlement agreement with Webb in the first case in the Florida federal court; where federal Judge Donald Middlebrooks signed a final judgment as to James Thomas Webb, with no crime, zero penalty, zero fine, zero forfeiture, zero restitution and zero disgorgement of funds and with the Court Ordered Sworn Accounting by a CPA furnished to the Securities and Exchange Commission?

Cheroke failed to tell the N.C. federal court the whole truth and knowingly caused other due process violations against Webb according to the over 400 pages of evidence in Webb's Dossier named "The Purge within Banking Risk Management". Webb hopes former agent Cheroke will admit to the existence of these violations. As far back as 2003 F.B.I. agent Jim Cheroke received emails from a group of Raleigh and regional risk management bankers, some who had determined they were going to "close Webb down" in what the Acting Chief of the United States Department of Justice Civil Rights Unit Criminal Investigative Division of the [F.B.I.], John E. Shimp referred to as a "Civil Rights Banking Conspiracy" when he referred the matter over to the Charlotte [F.B.I.] field office for appropriate action; according to a letter Shimp mailed to Webb in 2016.

Webb is currently before federal Judge James C. Dever III with a timely filed motion for reconsideration of his 2255 and Webb has filed asking Judge Dever to GRANT his subsequent jurisdictional motion and to dismiss the criminal case against him. The federal court in the Southern District of Florida had back in 2009 retained jurisdiction of both James Thomas Webb and the subject matter of the 2012-14 re-litigation in North Carolina Federal Court. Additionally Webb has petitioned the Florida federal courts for relief from the miscarriage of justice and to also release him from federal prison. Webb's dossier is free on line and he details both cases in another book entitled "Guide for President Trump on Rebuilding Poor Communities...". Webb has not been contacted by the [F.B.I.] nor government agencies since Mr. Shimp's letter. Webb did request for an attorney his family paid for him while in prison, to meet with the Raleigh United States Attorney to negotiate a resolution to the case, but the attorney refused to help facilitate a meeting unless Webb participated in a Rule 35 hearing and unless Webb agreed to dismiss his 2255. Banker Kenneth Thompson, CEO at the time of Wachovia Bank and Wachovia's international director of securities Richard Abrams worked together to close on a 20 million dollar equity partnership for the "front end" with Webb and Wachovia in a partnership where Webb would rebuild 3000 (three thousand) homes monthly in low income communities up and down the eastern seaboard, the antitrust group of over 40 powerful individuals combined in what Webb and James Shimp, Acting Chief of the Civil Rights Unit Criminal Investigative Division of the F.B.I. referred to as a Civil Rights Banking Conspiracy (CRBC). The combination members were also instrumental in canceling the imminent 20 million dollar equity deal between Webb and Wachovia Bank according to Richard Abrams, "the bank could not have any noise". Behind the scenes the (CRBC) was making a lot of noise. Not only did the (CRBC) stop the deal, but they convinced Washington D.C. Chief Enforcement Agent of the United States Securities and Exchange Commission A. David Williams to sue Webb in 2007 in Miami but the case was transferred to West Palm Beach, FL without the knowledge of Williams to hopefully deny Webb a jury of his peers, according to Williams.

The narrative was, according to Williams, that Webb's company was a Pump and Dump scheme and that the homes were "never renovated, never rented and never sold". WTVD 11 Steve Daniels in Raleigh, NC did an interview with a man who presented himself as an Asset Recovery Person and a former CIA official, John P. Quirk who cut deals with some of Webb's investors who were vulnerable due to the (CRBC) attacks as he perpetuated a false narrative that Webb had 20 million dollars offshore, in an attempt to hide what the (CRBC) had done to the Wachovia/Webb partnership. Many people believed Quirk. At the time it was not known that John P Quirk, in fact, was a "total fraud from head to toe" according to Joseph Spinelli former F.B.I. Agent and former Managing Partner of KROLL, the worlds largest risk management company across 20 countries. Quirk had been convicted by the State of Florida for impersonating a private investigator and CIA agent. Spy vs. Spy a FORTUNE magazine story also revealed how Quirk had perpetrated these fraudulent narratives against many others in his past as he took advantage of vulnerable people.

Quirk's false memos not only convinced Williams with the SEC to sue Webb but also 3 years after Williams found out the truth and had signed a settlement agreement with Webb allowing him to rebuild these communities across America and a Federal Judge Donald Middlebrooks closed the SEC case sua sponte in 2009. In 2012 that same false narrative was presented to the Eastern District of N.C. In her article she stated there are 550,000 homeless Americans and more than 18 million people spend more than 1/2 of their income on housing. Democrats who are currently running for President in this upcoming election are offering varied incentives for housing policies and increased tenant protections. Advocates for tenants and for the housing industry agree that supply is at the core of the affordable housing crisis and by some estimates America needs 7 million more affordable home units according to Astor. Sanders is promising 1.5 trillion in 10 years for the National Housing Fund Trust; Warren 440 Billion dollars for the Housing Fund Trust with an additional 250 billion for Capital Magnet Fund which builds low and moderate income homes; Biden 20 Billion and 100 Billion for Affordable housing Fund Trust. The Candidates also agree that the government should help low income Americans afford down payments. All 3 democrats agree "the federal government has an obligation to proactively address racial discriminatory housing policies from the past". Diane Yentel, President and Chief Executive of the National Low Income Housing Coalition said "after decades of chronic underinvestment by Congress, it is remarkable that presidential hopefuls are now using their platforms to elevate the housing crisis and it's solutions". "Candidates are talking more substantively about solutions to the housing crisis than perhaps any presidential campaign in history..."

According to supporters of African America's largest low income housing redeveloper and builder James Thomas Webb, the solution to the low income affordable housing crisis is currently locked up in a federal prison; after rebuilding close to 1000 (one thousand) affordable homes with a model monthly rental amount of $575.00 per month on homes with newly installed electrical, plumbing, HVAC complete systems; along with new baths, flooring, kitchens and many other upgrades (rebuilding vacant and previously condemned homes in blighted communities). Despite, even President Obama's personal "promise" to Webb at a Fort Lauderdale, Las Olas fundraiser held by Greenberg Traquig LLP months before Mr. Obama announced his plans to run for President of the United States of America, he told Webb "I know you are catching hell trying to rebuild those communities, but that is going to change because we are going to take the White House". For 27 years Webb had rebuilt affordable homes in low income communities across 7 states. He moved his family and office from Raleigh N.C. to Weston Florida to avoid some of the challenges. After a successful settlement with the U.S. SEC in 2009 and a final judgment to continue his low income housing model, 3 years later (2012) in the Eastern District of N.C., in the same case, same alleged offence timeframe of 2002-2006, for the same parties and privies; 114 low income families had been forced out of Webb's rebuilt homes before members of an antitrust combination had the homes stripped, torn down and some even burned to the ground.

Afterwards the homes were left in disrepair as an Obama era United States Attorney in the EDNC who resigned, commissioned the appointment by the U.S. Attorney General of a "special prosecutor" who reopened Webb's Florida federal case without permission of the 1st federal judge. As the tenants attempted to purchase the homes and become first time homebuyers the illegal combination of rogue risk management bankers with the assistance of Raleigh N.C. Chief F.B.I. Agent Jim Cheroke began in 2003 and continued for over a decade up until Cheroke testified against Webb in the 2014 sentencing hearing, to perfect their plan against Webb. One thing Cheroke failed to tell Federal District Court Judge James C. Dever III is that in 2003 he had received emails from the over 40 member combination of Banking Risk management officials stating their intention to "close Webb down". By that time Webb has already positioned over 20 million dollars on the refinance of homes which he rebuilt in blighted communities.

Despite the fact one combination member agreed in writing that the case was illegally grafted and that they lied stating Webb had never renovated, sold or managed the homes and that they forced the tenants out of the rebuilt homes, stripped the homes, torn down some homes and burned other rental homes to the ground; then defrauded the Federal District Court in both Florida in U.S. SEC v Webb from 2007-2009 and then again the Federal District Court in Eastern District of N.C. in U.S. v. Webb from 2012-2014, Webb received 27 years in federal prison due to the false narrative. This was all done despite the fact that N.C. State Investigative Officials at the N.C. Attorney General's office had during 2004-2006 visited the homes and the tenants who "lived" in the homes. In the grafted criminal case they told the Federal Grand Jury that tenants "never lived" in the same homes.

James T. Webb began in 1985 to purchase, renovate and refinance or resell close to 1000 homes, mostly single family homes in over a 27 year career, across 7 regions; North Carolina, Virginia, Memphis, Tennessee, St. Louis, Missouri, Caseyville, Illinois, Blytheville, Arkansas, and Miami, Florida mostly in the heart of blighted communities which many American's back then called "the Hood". The majority of these homes were in the 2007-2009 Washington, D.C. Securities and Exchange Commission Case against Webb, filed by a handful of investors who did not want to be landlords of the homes. The case was regarding about 500 homes which Webb's redevelopment companies purchased.

Webb started his building career in 1985 with only 200 dollars and a burning desire to rebuild his community and become successful and he grew into what many say was America's largest single family home redeveloper in America's blighted communities known by many as "the Hood" back before the new 2017 "opportunity zones" covering 8700 of these kind of communities. From 1985-2006, Webb kept his sales prices with a model price point of $65,000.00 per home after renovations. In the West Palm Beach, Florida Federal Court there was -0- disgorgement, -0- restitution, -0- fine or fee, -0- forfeiture in the SEC case; however three years after the SEC case closed, in another federal court in the Eastern District of North Carolina Webb was indicted based on the same alleged offence. Despite 139 grounds of alleged government violations in this case, one major due process violation stands out. In the re-litigation of the SEC case over in N.C. the loss amount in the second federal court ruling in the same case was 11.9 million dollars.

One big problem is that Webb never received $47,719,863.00 (forty seven million seven hundred nineteen thousand and eight hundred sixty three dollars) USSG 2B1.1note E (i) Credits Against Loss even though he furnished to the government CD's of accounting 30 days before sentencing and over 3 years earlier he was already required by the federal court in Florida to have a sworn accounting prepared by a Florida CPA showing that not only had Webb paid back all of the 1.3 million he received but in the 2nd re-litigation Webb proved he paid an additional $745,000.00 from his retirement which sent him into bankruptcy. So instead of the second case recommending a 2 year sentence with the 11 million being offset, the government ignored USSG 2B1.1Note 3 (i ) and recommended a 27 year sentence. Webb received 27 years and has been in prison away from his building business for almost 8 years now. This is a "miscarriage of justice".

One big problem is that Webb never received $47,719,863.00 (forty seven million seven hundred nineteen thousand and eight hundred sixty three dollars) USSG 2B1.1note E (i) Credits Against Loss even though he furnished to the government CD's of accounting 30 days before sentencing and over 3 years earlier he was already required by the federal court in Florida to have a sworn accounting prepared by a Florida CPA showing that not only had Webb paid back all of the 1.3 million he received but in the 2nd re-litigation Webb proved he paid an additional $745,000.00 from his retirement which sent him into bankruptcy. So instead of the second case recommending a 2 year sentence with the 11 million being offset, the government ignored USSG 2B1.1Note 3 (i ) and recommended a 27 year sentence. Webb received 27 years and has been in prison away from his building business for almost 8 years now. This is a "miscarriage of justice".

Press Release 2/6/2020 - US Antitrust Chief requested in Banking Antitrust Case

West Palm Beach, FL Supporters of an African American Affordable Housing builder and redeveloper are asking Assistant Attorney General of the Department of Justice antitrust division, Makan Delrahim to investigate the removal and relitigation of Webb's 2009 closed West Palm Beach, FL securities and exchange commission case no 07-61655-civ-MDD; removed and relitigated in the Eastern District of North Carolina, and to investigate the fraudulent concealment of not only it's removal and relitigation, but to answer the question of how over 100 low income families were forced to move out of the homes rebuilt by Builder James T. Webb. These rent paying families were forced to move out of the homes even as many of them had signed contracts to purchase the homes as first time homebuyers and as these tenants attempted to purchase the homes during the securities and exchange commission's case against Webb; a case which was settled with a settlement agreement in 2009 signed by Webb and signed by the government, where Webb was allowed to continue to rebuild these kind of homes in America's poorest neighborhoods.

According to the case record DE 109, a letter was sent to James Webb from John Shimp; Acting Chief of the U.S. Department of Justice Civil Rights Unit Criminal Investigative Division of the F.B.I. where Shimp referred the matter to the Charlotte, N.C. F.B.I. field office for appropriate action. No action has been taken since 2016. However, Webb is now before the Honorable Judge Donald Middlebrooks in West Palm Beach, FL Federal District Court with a petition called The GREAT WRIT where he is asking the judge who has the original and retained jurisdiction over the homes, the case and over Webb, to release him from prison in what many legal experts call a grafted and unconstitutional prosecution of Webb the builder, a criminal case riddled with due process violations covered under Pyle v. Kansas 317 U.S. 213, 215, 216 and Title 18 U.S.C. 844i as the same rebuilt homes were destroyed and some burned by fire after the families were forced out.

In Webb's GREAT WRIT he has 139 grounds and a book of evidence which assists the Department of Justice and the Judge in Webb's release and vindication. What is even more concerning is that the antitrust group's activities, known as the (Civil Rights Banking Conspiracy) "CRBC," are a pattern utilized to strip poor communities of wealth as families are displaced out of what is now commonly called empowerment zones. Webb's building and redevelopment business had created thousands of jobs and rebuilt close to one thousand affordable single family homes in these zones. According to Webb's affidavit the Chief S.E.C. agent on the case, A. David Williams admitted to Webb before signing the settlement agreement and before the Judge Closed the case Sua Sponte, that the members of the antitrust combination "plain lied on Webb".

In Davis v. Operation Amigo, Inc., 378 F.2d. 101, 11 Fed. R. Serv. 2d (Callaghan) 1060 (10th Cir. 1967) Marshall v. Sielaff, 492 F.2d. 917, 18 Fed. R. Serv. 2d (Callaghan) 616 (3d. Cir. 1974) the federal court stated that "Dismissal is harsh remedy and should be resorted to only in extreme cases, policy of law being to favor hearing of litigant's claim upon merits." Then why is it that in United States v. Webb and "related" "core proceedings" Webb has never received a hearing on the merits in federal courts based of this America Builders arguments against the federal government's use of double jeopardy on behalf of those who are powerful antitrust violators responsible for running over 100 rent paying tenants out of Webb's Rebuilt Affordable homes, then destroying the homes after powerful Risk Management Bankers in 2003 discovered their member banks had loaned over 20 million dollars on Webb's rebuilt $65,000 affordable homes.
Even as the banking employees admitted in a 1374 page banking report "Webb's redevelopment model was very successful and that he made huge profits for his investors and had broken no laws", with the aid of sophisticated lawyers, one who was a member of Kenneth Starr Impeachment Team against President Bill Clinton, they were able to create a false narrative stating that Webb never renovated, never sold and never managed these same homes. That narrative was debunked in the United States Securities and Exchange Commission's case against Webb and the case in 2009 was dismissed by Federal Judge Donald Middlebrooks in the Southern District of Florida Sua Sponte.
However, in a very smooth and sophisticated manner three years later after signing a contract with Webb giving Webb the right to continue his building model across America's poor communities as he had explained to the court how he created 1000's of short term construction jobs with members of these same communities rebuilding these homes, still the government workers were convinced by smart lawyers to reopen this case even without permission from federal Judge Middlebrooks and without permission from what is known as the Judicial Panel on Multidistrict Litigation, and transferred in a newly created Florida case in 2012, Webb's case to the Eastern District of North Carolina for re-litigation as a criminal case even though they did not win in the SEC case in 2009.
For 7 years now Webb has been in prison trying to get his case heard on the merits; in particular his arguments that his 5th Amendment Due Process Rights were violated as he described in his Blockberger Analysis of the Wire Fraud statute, compared to alleged Securities violations under 10 b 5 and the silent element of "instrumentality to defraud" which the United States Supreme Court said is the same offense, which should cause the Bankruptcy Appeals Panel to GRANT Webb's motion, so that he can get out of prison and get back to work creating jobs in America's poor communities and rebuilding affordable housing.

Around Christmas 2012 African American Builder James Thomas Webb was sitting in a jail cell at the Harnet County, NC jail when he got a surprise visit from his federal court appointed attorney Todd Allen "Smith", who had driven close to 2 hours from his office in Graham, NC. Once "Smith" arrived, Webb was called into the legal conference room where Attorney "Smith" asked Webb one question and left the meeting in 5 minutes. "Smith" asked Webb "if you could make a couple million dollars a year in construction and real estate could you be satisfied or do you have to try to rebuild all the poor communities across America?" Webb responded, "Read Ezekiel Chapter 34; as long as there are 10's of millions of Americans living in squalor needing quality affordable homes; 10's of millions vacant and condemned homes needing to be rebuilt and 10's of millions of Americans from these same poor communities who need construction jobs rebuilding homes, that is a question you must ask God. I have work to do and I am not an irresponsible shepherd." Attorney "Smith" stood up and looked at Webb and said "I thought you would have an answer like that." "Smith" then walked toward the exit door and motioned for the officer to unlock the door so he could leave. As he waited "Smith" told Webb, "I read the Bible, but I read the Old Testament". That one statement has taken Webb over 7 years sitting in prison to understand what "Smith" meant by it.

Obviously "Smith" knew that Ezekiel was in the Old Testament. Webb now believes "Smith" was making a different statement, maybe on behalf of those who sent him to ask that question. Thinking back, Webb recalled that "Smith" had previously told him that the government had promised Webb's immediate release if he would only sign the plea deal to one count of wire fraud; that Webb would be out of jail in days and would only receive a slap on his wrist with a few months in a halfway house and that he could then be able to get on with running his construction and real estate business. Webb had signed a contract being promised the same by the government in the "same case" in 2009 under Federal Judge Donald Middlebrooks in West Palm Beach Florida where there was no crime. However this time the government or "Smith" lied and ignored the promise to Webb and asked federal Judge James C. Dever III in (2014) in the same 2009 Closed Case to give Webb 27 years in prison for that 1 count of wire fraud which was also within the statutory meaning of the Securities charges in the 2009 case that the Florida Federal court never found Webb guilty of a crime. The government in the 2012-14 Re-Litigation of the same case got their request for the 27 years in prison for Webb. Webb has been in prison now for over 7 years.

From another jail cell on December 21, 2019 as he reflects and continues to fight (PRO SE) for his freedom now in the Southern District of Florida in front of the Federal Bankruptcy Appellate Panel of Judges under special jurisdictional rules Webb understands more now: Webb's former Attorney Todd "Smith" N.C. Federal District Court appointed counsel; Webb's former Attorney Anne "Hayes" Federal Appeals Court appointed counsel; F.B.I. Agent Jim "Cheroke" who had received emails in the Civil Rights Antitrust Banking Conspiracy (CRBC) against Webb in 2003 where over 40 (CRBC) members in emails admitted that they intended to "Close Webb down" while admitting he had committed no crime (however "Cheroke" in 2014 testified at sentencing he had never heard of Webb until 2004)(2016 Acting Chief DOJ CID FBI John Shimp's referral of this case disappeared); Attorney James N. Currin) in his early release from prison; Assistant EDNC prosecutor U.S. William "Gilmore" hired from the Southern District of Florida; journalist Jennifer "Strom" writer of the infamous "Smooth Operator why do so many people keep giving James Webb all of their money" one sided prejudicial expose against Webb and Webb Companies in 2006; Steve "Daniels" WTVD 11 news anchor who flew to Florida from EDNC to interview Webb on his front door step in the Weston Florida Gated Subdivision as over 100 low income African American families in multiple states were being forced by CRBC members to leave the same rebuilt homes, before the homes were vandalized, stripped and burned by (CRBC) members as in U.S. SEC v Webb Doc 50 Webb, showed Judge Middlebrooks how the tenants they wanted to buy the homes, (not knowing that a 2nd federal fraud was being engineered for another federal court in the same case at the same time just in case Judge Middlebrooks ruled against the CRBC).

Now, Webb finally get's it. Webb is "sorry", not for breaking the law, because he did not. But he is "sorry" that he upset powerful leaders in the Jewish community as he rebuilt 100's of homes in poor communities and paid over 50% annualized returns on investment to private investors. Webb says if the CRBC member banks would have only said yes to his development loans in poor communities as they said yes to him as he built million dollar SPEC and estate homes Webb would have never needed private investors. Webb says nevertheless "it is a very dangerous thing to allow our Criminal Justice System to be used to punish anyone of any race or religion, because they did "too much" business in the wrong community". Furthermore Webb says that many of his childhood mentors and mentors in business were leaders of the Jewish community in Wilmington, NC, Charleston, SC, Red Bank, NJ and other parts of the nation. Last night this nation witnessed some of the strongest words from both sides, with complaints about "Guilty until Proven Innocent", "Where the Law ends Tyranny begins", "A Dark Cloud has descended upon these hearings", "Nothing was going to get in their way, especially the Truth"; even a threat about legal disbarment when one acts as Prosecutor, Judge, Jury and executioner. These same feelings go through the minds of some Americans in our Criminal Justice System who are innocent but who plead guilty; not to a crime, but to the powerful system with a 98% conviction rate.
In a case filled with what some say are the worst due process violations in America's history, African American Builder James Thomas Webb who is a Republican has been sitting in a federal prison for over 7 years; 10 years after Federal Judge Donald Middlebrooks, appointed by President William Clinton CLOSED his case U.S. SEC v Webb et al. in 2009. The Final Judgment as to James Thomas Webb was with no guilt, no restitution, no disgorgement, no fee and no fine. That case was able to be filed based on what Washington D.C. Chief Enforcement Agent A. David Williams later called "plain lies" against Webb after the same case, as a bankruptcy case was closed by another Federal Judge John K. Olson due to threats and illegal coercion. Webb says that his having to file bankruptcy was the result of powerful risk management bankers in a group of over 40 individuals who promised in emails to "close him down" back in 2003 after he had renovated 100's of homes in low income black communities and had over 20 million of bank financing on the homes in redlined and community coded zones.
Webb says after the antitrust violators; ran over 100 low income families from the rebuilt homes, had the homes stripped, some torn down and even burned to the ground in violation of Title 18 USC 844 i, the combination members lied to a different and third Federal Judge in Florida who reopen the closed case and transferred the case to the Eastern District of North Carolina for Webb to stand trial in the same case, but this time in 2012 it became a criminal case based on the same 2002-2005 timeframe as in the 2002-2007 SEC closed case; same parties and same lies. Webb stood trial in front of yet another and fourth Federal Judge James C. Dever III in this case. Judge Dever was appointed by President George Bush. Webb received 27 years in prison from the forth Judge for 1 count of wire fraud in the same closed case where Webb says he took an unknowing, coerced and unconstitutional plea in a case which should have never been filed as it was already closed. Webb says the powerful antitrust conspirators GRAFTED the illegal case and created a false narrative, that he had never renovated; never sold and never managed the same homes they destroyed. Wire fraud is a statute that a former indicted U.S. Senator said "you could use to indict a ham sandwich". In the fourth N.C. re-litigation of the same case the antitrust violators were awarded 11.9 million dollars, while Judge Middlebrooks had awarded them -0- before he closed the case Sua Sponte around Christmas 10 years ago.
Now, Webb is also before a fifth Federal Judge, Beth Bloom appointed by President Obama in Florida in his appeal to Reopen the original 2006 bankruptcy case after Federal Bankruptcy Judge John K Olson denied his request to grant him a reopening to liquidate new assets and for a habeas to release him from prison in this same case. One of Webb's reasons to reopen the case could be allowed under 11 U.S.C. 350 for the purpose of investigation of the complex antitrust conspiracy which is an asset to the estate and which Webb alleges now owes Webb's estate and his creditors millions of dollars for its violations of State and Federal antitrust laws.
Before admitting he had never had anything like this to come before his court and after giving Webb only a couple sentences in a prison phone hearing to tell him what the antitrust violators did to him, Judge John K. Olson denied Webb's motion. Webb hopes this Appeal will be GRANTED by Federal Judge Beth Bloom. Before President Obama appointed Judge Bloom he told Webb in Florida even before he ran for office that he knew Webb was "catching hell trying to rebuild those communities, but that is going to change because we are going to take the White House". Webb said "unfortunately things got a whole lot worse."
In 2012 an Obama appointed N.C. U.S. Attorney Thomas Walker (who resigned), indicted Webb, after representing Webb's "lawyer at all times" former Attorney Samuel T. Currin who was also the former Chief U.S. Attorney for the eastern district of N.C. and the Judge Advocate in Chief of the Sons of the Confederate Veterans. Webb said Currin stood up against the powerful antitrust combination before Currin's indictment, but under pressure in his F.B.I. 302 Report said that his representation of Webb "was a mistake." Webb has been a good prisoner despite his innocence and has taught over 300 men in his construction and real estate classes to return and to rebuild America's poor communities. Webb says this Christmas he is just really ready to get out of prison; maybe he will come back prison to visit and continue to teach construction later, but "it's time to get back to rebuilding America's older homes in America's low income communities," and to finally experience his constitutionally protected due process as an American citizen and to see life come back to THE RULE OF LAW.

Press Release 12/16/19 - African American Affordable Single Family Home Builder says new banking proposal will crush Poor communities

Banking regulators disagree on a rule that would give Banks a break under a new proposal released on Thursday by the Federal Deposit Insurance Corporation and the Office of the Comptroller of the Currency. The Federal Reserve Chair Jerome Powell is not on board yet. Banks for decades have called the Community Reinvestment Act (CRA) burdensome, impractical and unfair. Many jobs and affordable housing advocates across America see some provisions of the (CRA) as necessary due to the disconnect between some regulatory agencies, the banks they regulate and protect and the risk management employees of many banks who misinform their board members and the banks' shareholders about the risks and profitability within low income communities. Lynn Turner former chief Accountant of the Securities and Exchange Commission (SEC) from July 1998 to August 2001 said in International Monetary Fund Volume 4 of Current Developments in Monetary and Financial Law: "One of the things that distinguishes wise individuals from those who may be intellectually superior, but not wise, is the ability to avoid repeating one's mistakes....when left to their own devices some people believe incentives created an environment in which the end came to justify the means, even if that end could ultimately inflict tremendous personal and economic damage to thousands of others." This is what happened to African American Builder and re-developer of single family homes across America's poor communities, James Thomas Webb at the hand of risk management bankers. Instead of partnering with Builder Webb as they did in non African American communities, even after stating in writing that his affordable home redevelopment model was very successful, risk management employees lied on him and created a false narrative to have him thrown into prison. Webb had purchased, renovated and leased close to 1000 homes in poor communities over a span of more than 2 decades and created 1000's of jobs. Webb had also served as CRA Chairman in the 1980's for both Wilmington N.C.'s poor communities and as Barclays Bank CRA Chairman in Wilmington N.C.. Washington D.C. (SEC) Chief Enforcement Agent A. David Williams said that between 2002 and 2007 Webb did over 100 million dollars of redevelopment of these homes. However a risk management group of over 40 individuals in 2003 combined and had weekly "target training sessions" in FDIC banks with one primary goal confirmed in their emails: "CLOSE WEBB DOWN". Webb says it took them 8 unsuccessful litigations in multiple states and forums before the Southern District of Florida Federal District Court Judge Donald Middlebrooks "closed their case down" Sua Sponte. That did not stop them as they ignored federal court rules and statutes then convinced the Florida Federal Court to reopen the same case without Judge Middlebrooks' permission in order to have Webb sent on a diesel type prison circuit tour back to the eastern district of North Carolina to stand trial in the 9th re-litigation of their case. Except, this time they convinced the government to file the same charges as criminal charges against Webb; 3 years after the case was CLOSED. After 7 years in prison in an unconstitutionally GRAFTED banking risk management case, Webb still fights for his freedom but has graduated over 300 federal prisoners in his Construction and Real Estate Classes as he teaches prisoners to go back home to rebuild America's poor communities. Without the Community Reinvestment Act and other similar laws Webb says he believes that he would have been not only financially, but also physically, lynched at the hand of rogue risk management bankers. Press Release 12/10/19 - LOCKING UP THE COMPETITION: WILL YOU BE NEXT?

In 2003 Dir. of Financial Services for Alpine Properties, LLC; Stephanie Duguid met with Chris Manson of RBC Bank/PNC in the eastern town of Rocky Mount, NC to do a walk thru on a group of homes that had been recently rebuilt by Webb Builders LLC. These homes were from 1000 to 1400 square feet single family residences that had been rebuilt with new kitchens; new baths, electrical and plumbing systems; new walls, new flooring, with new fixtures through out. These homes which used to only have space heat and window air conditioning now had new central heating and cooling systems. The sale prices of the rebuilt homes was around $65,000.00. Surely one would think the Senior Banker would be pleased with the work done on these homes in his low income community; and not opt to rather call a meeting with his Risk Management Banking friends at 6 other banks to target and criminalize African American home builder James Thomas Webb and ultimately have him thrown into prison.

After committing to writings in emails and in handwritten notes, to "Close Webb Down" the group of over 40 businessmen with the power of at least one F.B.I. agent in the group proceeded in a "secret society" style manner where they held weekly target training sessions, in F.D.I.C. banks; with former Webb Company employees, and worked to perfect their efforts which included the gentrification of Eastern NC communities. Their activities never ended, even today. Congruently, in the process, the "combination" ran over 100 African American low income families out from their rebuilt homes; the homes were stripped, torn down and some even burned to the ground as Alpine Properties LLC and Webb Builders LLC were "closed down" after Webb himself had been thrown into prison in a false conspiracy which was a refiling of a closed case where the federal government S.E.C. was forced to sue Webb after he moved to the southern district of Florida for his and his family's protection after threats.

That was however, the ninth litigation of that case by the members of the group which had been expanded to include some of Webb's investors. Finally, they convinced federal prosecutors of EDNC in 2012 to reopen the "closed case" with the appointment of a special prosecutor in the illegally GRAFTED case where their attorney admitted in writing how he would graft in Attorney Amy Robinson and appraiser Larry McDaniel to lie on Webb in order to fully "close Webb down". They even manipulated one F.B.I. agent Jim Cheroke who had received the 2003 emails, to become their lead witness against Webb in it's unconstitutional prosecution of American Builder James Webb. Webb who has become a diligent student of the law while in prison has now presented his evidence to 5 federal Judges in a free book entitled "The Purge within Banking Risk Management" https://payhip.com/b/940q and in other federal court filings. This matter is now again before West Palm Beach, Florida Federal Judge Donald Middlebrooks, Raleigh, NC Federal Judge James C. Press Release 12/5/19 - WILL FIVE UNITED STATES FEDERAL JUDGES CORRECT THIS JURISDICTIONAL SOLECISM

Five United States Federal Judges are to review the aftermath of what has been called one of Ebenezer Scrooges' worst catastrophes of all time, after over 100 African American families were forced to move out of their rebuilt homes in what many called black segregated communities, located next to areas that were being gentrified. However, scrooge in this scenario is not the fictional elderly man, instead, this scrooge represents a powerful antitrust "combination" referred to by John E. Shimp Acting Chief Civil Rights Unit Criminal Investigative Division of the U.S. Department of Justice Federal Bureau of Investigation in Washington D.C. in a letter on July 21, 2016 to African American Builder James Thomas Webb, as a civil rights banking conspiracy. Mr. Shimp referred the investigation over to the Charlotte F.B.I. Field Office for review and appropriate action.
Interestingly enough, it has been over 3 years now and Webb has not heard back from either the F.B.I. Acting Chief Shimp nor the Charlotte F.B.I. Field Office as he remains in federal prison as a direct result of the actions and damage caused to the over 100 homes, by the "combination" even as the combination well documented their actions of a 10 year long effort as they vowed to "Close Webb Down". After 9 vexatious state and federal actions that lasted for a decade, the last action by the combination members caused the Eastern District of N.C. United States Attorney's office in 2012, 3 years after Federal Judge Middlebrooks CLOSED this case Sua Sponte in 2009, to file the same case as a criminal case against this American builder; despite the fact that Federal Judge Middlebrooks had signed a Final Judgment as to James Thomas Webb in this case in 2009. Webb said if they had a case, which he denies they had a constitutionally valid case, it should have been filed before the 1st Federal Case in Florida Closed, as both N.C. and Florida Federal Courts are the same sovereigns; in a case for the same parties, for the same alleged offense during the same 2002-2007 time frame and regarding the same homes.
Also, In the 9th vexatious action the N.C. Eastern District of North Carolina's United States Attorney's office filed a criminal case against Webb, requesting that the Southern District of Florida open a new case in 2012 (in the 2009 Closed Case) and that the Miami F.B.I. arrest Webb at his North Miami Beach residence and transfer his body to the eastern district of North Carolina to stand trial for the exact same alleged offenses, on behalf of the same parties, some of whom Webb testified in the prior S.E.C. case are members of the combination who ran over 100 families out of the homes his company rebuilt before they stripped the homes, tore some down and burned others to the ground and then had the key witness to their crimes killed to fraudulent conceal their crimes in this multi jurisdictional and same sovereign case.
Webb's former attorneys quietly admit that the parties behind this case are so powerful that they fear proceeding on the record on his behalf. As a result Webb has been required to transform from a master builder to a student of the law attempting to master an understanding of The Rule of Law. The challenge Webb says is that the same fear of the powerful combination members may have impacted at least one federal Judge. Now Webb's case is before Federal Judge Donald Middlebrooks S.D. Fla; Federal Judge James C. Dever III; and 3 Federal Appeals Court Judges in the 11th Circuit. In an interesting turn of events, the words of Senator Mondale from (1968) will ring loud in December (2019) within the Chambers of the United States Federal Bankruptcy Court. As principal sponsor of Title VIII, Senator Mondale stated "we do not see any good reason or justification in the first place for permitting discrimination in the sale or rental of housing." 114 Cong. Rec. 5642 (1968). But his context, like that in which the entire debate occurred, concerned the maintenance of segregation, not integration. His point was there was no reason for discrimination against a Black who wished to live in a previously all-white housing project. The purpose of Title VIII, he said, was to replace the ghettos "by truly integrated and balanced living patterns". Mondale pointed out "One of the biggest problems we face is the lack of experience in actually living next to Negros"..." laws enacted to enhance the opportunity for people of all races to live next to each other should 'not be' interpreted to prevent a landlord from maintaining one of the most successful housing projects in America.'" Wilmington, NC native African American Single Family home builder James Thomas Webb, has such a project which began rebuilding segregated neighborhoods such as; Red Cross Street in Wilmington, NC. During his mid 20's, in 1985, Webb owned single family homes he rebuilt from 5th and Red Cross Streets up to McCrea St. (known as "ugly town"). Now these areas are not segregated at all. Homes which Webb rebuilt and sold for under 65,000 dollars in 1985-90 now sell for over 150,000. For over 2 decades Webb's model the WAHM (Webb Affordable Housing Model) rebuilt segregated black neighborhoods in NC, VA, TN, MO., IL, and Arkansas into 2007, after Webb moved his offices to Weston Florida. Concurrently, Webb also built million dollar estate homes in mostly white neighborhoods, while he also enjoyed watching the change in the landscape of the homes in the "hood" that most people had forgotten about, "before" gentrification that is. Before the gentrification periods for these neighborhoods, Webb "caught hell" rebuilding them, as former President Obama described it to Webb one evening in Las Olas, Ft. Lauderdale at an event before his run for President of The United States of America. It was much easier for Webb to obtain a one million dollar loan to build a home at 12650 Boyce Mill Home in Raleigh N.C. than a 40,000 loan to rebuild 923 Beal Street in Rocky Mt. N.C. (childhood home of boxing legend Mohammed Ali) or 1739 Thru St. in Rocky Mt... Webb's challenges to gain financing in segregated black neighborhoods has led him to the offices of national bankers such as former CEO of Wachovia Kenneth Thompson and former international director of securities for Wachovia Rick Abrams who attempted to close a 20 million dollar equity deal with Webb; to international law firms like Greenberg Traquig of Ft. Lauderdale, a firm who became a partner in a redevelopment project with Webb's CITIRISE REDEVELOPMENT LLC in a small 3 million dollar fund deal. All of these efforts Webb says and even a 5 Million Dollar mortgage warehouse line of credit commitment at Regions Bank in Raleigh N.C. was dismantled due to harassment levied by forces adverse to the redevelopment of segregated black neighborhoods. These forces also caused Webb to loose his liberty.Today in Judge John K. Olson Court, Webb fights for his Model, and for his creditors and investors who supported his model as well as for his freedom. Webb's fight includes maneuvers for even some of those who became his adversaries in the mist of this challenging market place. Webb's model and his freedom as he defends his model are also in the hands of 2 other federal Judges today in U.S.SEC v Webb id (Closed Case) 07-61655 Judge Donald Middlebrooks Miami/West Palm Beach and reopened 2009 closed case 5:12-cr-301 Judge James C. Dever III in Raleigh N.C. The Rule of Law tells Webb, that it's TIME TO REBUILD AMERICA from the bottom up again. In 1944 Judge Learned Hand wisely cautioned the judiciary that "there is no more sure way to misread a document than to read it literally". Webb's fate and the future of the reconstruction of America's black segregated low income communities is now in the hands of 3 federal judges. Surely one of them will allow Webb to rebuild his community once again.

Thanksgiving, according to Webster's Dictionary is the act of giving thanks; a prayer expressing gratitude; a public acknowledgment or celebration of divine goodness. As American Affordable Single Family Home Builder James Thomas Webb was asked what he thought about the November 26, 2019 national news report of 3 Baltimore men having their convictions overturned after spending 34 years in prison for a murder they did not commit, Webb said "it is a celebration of peace and divine goodness, for those men and for America's Criminal Justice System, while one day behind bars is one too many when you are innocent of the charge, to taste the sweetness of freedom erases the sour pain of injustice." So often the pain of injustice rises up where Americans would least expect it to exist. Despite the many strides over the years in a quest for justice where some are emancipated, many American Citizens are still threatened with a lifetime in prison, and many forgo some of the wonderful constitutional protections of a trial by a jury of their peers and opt out for a plea deal. In their minds many are not taking a plea of guilty (despite what the court document says), instead they are pleading to "the system" with a 98% conviction rate hoping for favor as they fear the power of coercive tactics, which if viewed by the general public such tactics would be considered "fowl blows"- blows sometimes even perpetuated by those esteemed law enforcement and judicial officials who have taken oaths to disallow the same.

In the process of searching for justice in America's powerful and complex judicial system sometimes it does not matter if the Rule of Law screams out in favor of freedom. In far too many cases the power of the media; structured negative public relations and whisper campaigns advanced by adversaries of the defendant, politics and plain personal biases, ultimately allow the victory to be awarded to what some legal scholars call the "cheat elite". The "cheat elite" stops the Rule of Law's Jurisprudence. Over 2000 years ago, one Judge said, "I find no fault in him"; however the cries of people demanded that Jesus Christ be crucified. How far have we really come in this evolving society?

Having conquered his inability to understand the law (Juris ignoranta est cum nostrum ignoramus) Webb, is now a pro se litigant before 3 federal Judges in the "same case", in 2 different federal courts of law in EDNC and S.D. Fla. African American builder James Thomas Webb will ask Judge John K. Olson to reconsider his motion to reopen his Chapter 13 case under 11 U.S.C. 350 and 5010 along with the All Writs Act for the investigation of the Civil Rights Anti Trust Conspiracy and the illegal incarceration of this Affordable Home Builder who rebuilt homes in what America now refers to as "Enterprise Zones". This will give Judge John K. Olson jurisdiction to issue for Webb a habeas corpus to release Webb from an illegal prison sentence in a case which was re-litigated 9 times after the "combination" was unsuccessful from 2003 until 2012 in "closing Webb down". On November 4th, 2019 Webb's motion was denied at a hearing in Fort Lauderdale by Judge John K. Olson. As Webb spoke, he was careful to "not" disrespect the Judges' wishes and kept his responses to only a few sentences which the court asked him to do. Unfortunately, Webb did not have the time to inform the Judge about the suspected murder of a key witness in his case, named William K. Graham from Durham County, NC. While on the subject, there is no statute of limitations for murder. Webb previously stated and continues to stand on the fact, that this particular witness had additional evidence of how members of the antitrust combination forced over 100 residents out of his rebuilt homes in downtrodden communities (Empowerment Zones) across 7 states before they stripped the homes and burned some of them to the ground and submitted False Claims to a federal official for payments from the government on losses which they created. In a case with it's roots in economic liberty, on Monday November 4, 2019 at 1:00PM at the United States Bankruptcy Court, 299 East Broward Blvd. Courtroom 301 Fort Lauderdale, FL. James T. Webb, known by his supporters as the nations' largest redeveloper of previously distressed single family homes in America's most downtrodden communities (currently called Empowerment Zones) will take the stand to plead his case and seek impunity. Webb would like you to take notice since he created 1000's of construction jobs for low income craftsmen and provided close to 1000 quality affordable homes; he rebuilt a city block of homes in one city where his Companies alone rebuilt and rented out 180 affordable single family homes.

However, there was no medal of honor received for his good works, only retribution. Around 2003, a group of over 40 Risk Management Banking employees and others in high positions from the Eastern District of North Carolina privy to the injustice "combined" as they circulated the following email:

"I will hold off on closing down Webb, I will be riding out to his Boyce Mill Address this afternoon, however all the reports I get back is that he makes his investors huge profits and gets good rents for the houses that they rehab. His model appears to be successful. I will keep you posted. Our best chances on this one is to work together." They did just that and in the process broke many antitrust laws.. But why? And how many "good people" did they get involved from Florida to N.C. to help them break federal laws to accomplish their goal to close Webb down?

Webb, at his peak did produce 1700 percent cash on cash annualized returns which made his competitors angry. However, he was not a banking risk management threat at all. Webb was and still is only a threat to poverty, blight, violence, joblessness and homelessness in America's downtrodden communities. Nevertheless, 16 years later at the hands of a couple of government officials who assisted the "combination" Webb fights for economic liberty, his estate, his creditors, his physical liberty and the future of the residents who currently live in America's Empowerment Zones. Webb created The Webb Institute Of Construction Technology, LLC. These homes were located in the heart of America's most downtrodden neighborhoods across 7 states. The same Bankers who previously loaned millions of dollars to Webb for building upscale mansions denied his request and told him NO for loans in downtrodden communities. Webb went on and raised over 8 million dollars starting in 2002 and produced revenue over 100 million dollars by 2007 according to the Securities and Exchange Commission. Today, with empowerment zones in place and the potential help of Wall Street Legend Michael Milken and with the assistance of President Trump; Webb's dream may come true. With one specific and primary condition "NO TAKEOVER". Webb says he was sent to prison at the hands of an antitrust banking conspiracy that attempted to take over his Companies. Reopening of a Florida bankruptcy case may pave the way for a multi-billion dollar race based antitrust lawsuit African American Builder James T. Growing up in North Carolina, Webb became Student Government President at North Brunswick High School in Leland N.C.; Most Valuable Player on the Basketball team; Brunswick County winner of the Odell and Virginia Williamson Oratorical Scholarship award which helped pay his way through college at North Carolina Central University where he was chosen as Who's Who Among University College students and served as President of the Student Body.
In hindsight, what Webb experienced in regards to race relations as a child growing up, was much different once he became a businessman, as he was rebuilding distressed homes in North Carolina's and other states poorest African American Communities. As a commercial unlimited builder Webb also built mansions, and different Church construction projects such as his renovation of the new Chancel renovation at the world renown White Rock Missionary Baptist Church in Durham, N.C. Although he was successful with these latter ventures, his passion was to focus on rebuilding homes in America's "hoods". While living out his passion project, Webb was able to watch and see as the homes and the lives of the local construction workers became rejuvenated. Webb not only rebuilt 100's of previously condemned single family homes; he also rebuilt the lives of 100's of men. Many of who were ex felons. Together they rebuilt these homes which many in the community previously called "crack homes or trap homes" that were beyond repair. Webb had a vision for these homes and for these communities. The homes were beautiful before the antitrust combination destroyed them.
Since Banks would no longer loan Webb money to rebuild in these poor communities Webb went to private investors for loans and created a portfolio of around 500 homes in N.C., Va. Tenn., Ark., MO. and Ill as he transitioned his business from Raleigh N.C. to Weston Florida. Noteworthy is prior to not qualifying for loans to rebuild poor communities, one bank had offered Webb a million dollar loan to build a 1.8 million dollar SPEC home. After winning 8 battles in multiple venues which were sponsored by the antitrust conspirators as they worked to "close Webb down", Webb was allowed by government agencies to advance his model with certain compliance and securities filing requirements. WAHM (Webb Affordable Housing Model) created 1000's of short term construction jobs and curved recidivism in the markets Webb worked. In the 9th vexatious action against Webb which unconstitutionally took his freedom with the same case that was CLOSED by Federal Judge Middlebrooks in Palm Beach in 2009, mysteriously was transferred (3 years later) back to N.C., the home of a group of over 40 members of the antitrust combination in their last effort to "close Webb down" and to take his liberty, as they promised in emails that they would do while admitting Webb had broken no laws. Their antitrust actions were discovered by Webb after they forced him into bankruptcy and after his bankruptcy case had closed. Because of a federal bankruptcy law Title 11 U.S.C. 350 and Rule 5010 Webb is now entitled to file for his bankruptcy case to be reopened in order to investigate the antitrust actions.
